In our view, Olshan's argument only confirms that the service provided was a valuable addition and improvement to the property and not a replacement for the original system. In particular, we find no evidence that the installation of a cooler is merely a repair or replacement. After examining this approach and other cases on this topic, I come to the conclusion that assembly and installation in one gear - in coolers are both valuable additions and improvements to the real properties.
The defaulting law includes a fraud exemption, which is found in Section 1 (b) (2) of the Tennessee Code, as described in Section 2 (a) (1) (B). The application of this statute precludes the prosecution of acts in which the defendant negligently carried out the improvement or establishment of the measure or unlawfully concealed the cause of the act.
